This contribution provides an account of the decision-making processes for designation of offshore wind energy in Denmark according to the Renewable Energy Act. Offshore wind energy in Denmark faces a particular problem in the interaction between the decision-making process and the tendering procedures, which are linked to specific locations and thus require prior planning and assessment of the individual locations. This complex interaction poses special challenges, among other things in relation to the implementation of environmental impact assessments, and the associated involvement of citizens and authorities concerned in the subsequent permitting process, where the design of the wind farms is clarified.
The contribution will primarily focus on the decision-making process for offshore wind farms established on the basis of a site specific tender which requires prior strategic planning in the form of pointing out suitable locations. The identification of possible locations is followed by the so-called feasibility studies with associated environmental impact assessments of the selected sites. Subsequently, the tendering procedures start, and only when it has been decided who wins the tender, the relevant permits can be communicated and a detailed planning of the offshore wind farm can take place. The quite complex decision-making process raises certain issues with respect to the involvement of both local authorities and the public, among other things in connection with environmental impact assessments and the related access to justice. This is illustrated in a case concerning the near shore wind farms - more precisely, the Vesterhav Syd offshore wind farm project
